Terms of Service
These Terms of Service (“Terms”) govern your use of the Peninsula Smart Care website at pensmartcare.com.au (the “Site”) and any purchase of products or services from Peninsula Smart Care (“PSC”, “we”, “us”, or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Using our website
You agree to use the Site only for lawful purposes, and not to misuse it, interfere with its operation, or attempt to gain unauthorised access to any part of it or its underlying systems. We may change, suspend, or withdraw any part of the Site at any time without notice.
2. Products, quotes, and pricing
We supply electronic security and healthcare communications equipment and related services. Product descriptions, images, and specifications are provided as a guide and may change without notice. Unless stated otherwise, prices are in Australian dollars and include GST where applicable. Quotes are valid for the period stated on the quote, or for 30 days where no period is stated, and remain subject to product availability and to change before acceptance.
3. Orders and payment
An order is an offer to purchase, which we may accept or decline. A contract is formed only once we confirm acceptance of your order. We may decline or cancel an order — including where a product is unavailable, a pricing or description error has occurred, or we are unable to verify your details.
Unless otherwise agreed in writing, a deposit of 50% is required on all orders before we order equipment, schedule works, or commence supply, with the balance payable on or before completion or delivery as set out on your quote or invoice. Deposits are non-refundable except to the extent required under the Australian Consumer Law — for example, where you are entitled to a remedy for a failure to meet a consumer guarantee. Title to goods remains with us until payment has been received in full.
4. Overdue accounts and recovery costs
Invoices are payable by the due date shown on the invoice. If an account is not paid by its due date, we may, to the extent permitted by law:
- charge interest on the overdue amount at the rate fixed from time to time under section 2 of the Penalty Interest Rates Act 1983 (Vic) (currently 10% per annum), calculated daily from the due date until the amount is paid in full;
- suspend or withhold any further supply, delivery, installation, or services until the overdue amount is paid;
- recover from you all reasonable costs and expenses we incur in recovering, or attempting to recover, the overdue amount — including debt collection agency fees, dishonour or failed-payment fees, and legal costs; and
- place the account on hold and require payment in advance for future orders.
These rights are in addition to any other rights or remedies available to us at law.
5. Delivery and installation
Delivery timeframes are estimates only and are not guaranteed. Where we provide installation, commissioning, or other services, those services are subject to any separate scope, quote, or agreement provided to you.
6. Warranties, returns, and your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Information about faulty goods, change-of-mind returns, and restocking is set out in our Returns & Refunds Policy, which forms part of these Terms. Any manufacturer warranties are in addition to, and do not limit, your rights under the Australian Consumer Law.
7. Limitation of liability
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. To the extent permitted by law, our liability for a failure to comply with a consumer guarantee (other than a guarantee as to title, undisturbed possession, or undisclosed securities) is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so. To the extent permitted by law, we are not liable for any indirect or consequential loss.
8. Intellectual property
All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Peninsula Smart Care and is protected by law. You may not reproduce, distribute, or use it without our prior written permission.
9. Privacy
We handle your personal information in accordance with our Privacy Policy.
10. Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
11. Changes to these terms
We may update these Terms from time to time. The current version will always be available on the Site, with the “last updated” date shown below. Continued use of the Site after a change takes effect means you accept the updated Terms.
